SMS Terms of Service

By opting in to receive text (SMS) messages and phone calls from Found Health, Inc. (“Found”) and our affiliates, or by sending Found an initial text message (an "SMS Enrollment"), you consent to receive automated, recurring text messages and phone calls related to your Found account and your prospective or ongoing use of the Services. These terms and conditions constitute the SMS Terms of Service ("SMS Terms of Service") for Found. SMS messages may include order confirmations, shipping notifications, communications from your Found coach, and other transactional messages, as well as promotional and marketing notifications, provided you have opted in to receive such messages from Found. By completing the SMS Enrollment, you represent and warrant that: (1) you are the owner or authorized user of the mobile device you used to initiate the SMS Enrollment, (2) you have provided express written consent where required, (3) you have the authority to approve any applicable charges associated with the text messages and phone calls sent to and received from Found, (4) you will be responsible for any messaging and data charges that may apply for messages and phone calls sent to you from Found, or from Found to you, and (5) neither Found, nor your or Found's mobile carriers, will be liable for delayed or undelivered messages or calls.
You acknowledge and understand that your access to Found's Services is not conditioned upon your consent to receive marketing or promotional text messages or phone calls from Found. You may opt out of Found's SMS services at any time by texting or saying "STOP" in response to a message or phone call you received, from the mobile device that is subscribed to receive the messages. After sending the "STOP" message, Found may send one final text message to confirm that you have been unsubscribed. If you have opted in to receive more than one type of text message from Found, you must opt out of each service individually. Until you have unsubscribed from each type of SMS service, you may continue to receive the text messages from Found to which you are subscribed. You also understand that certain regulations require that the consent you provide is documented, and you may request a copy of your consent record at any time. Additionally, clear and conspicuous disclosures have been made regarding any potential charges you may incur as a result of receiving text messages.
As required by and through our supporting third-party carrier, we attest that we will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your personal information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages."
Found will use commercially reasonable efforts to adhere to applicable state regulations regarding quiet hours for sending messages. You acknowledge that while Found is committed to protecting your privacy and the security of your sensitive information, the transmission of information over the internet and mobile networks is not completely secure. Text messages sent to or received from Found are not encrypted, which means there is a possibility that they may be intercepted by third parties. By choosing to send or receive information via text message, you do so at your own risk. By initiating an SMS Enrollment, you consent to sending text messages to Found and receiving text messages from Found that are not encrypted.
By completing an SMS Enrollment, you also consent to receiving messages and phone calls from automated agents that may rely upon artificial intelligence (“AI”) to respond to your questions and concerns. These automated agents may access personal information you have shared with Found to provide more relevant information and assistance. Please note that while Found’s AI is designed to enhance support, we cannot attest to the complete accuracy of responses, and occasional errors may occur. For the avoidance of doubt, the AI does not provide medical advice; for any questions regarding your health or treatment, please speak with your primary care doctor or speak directly with a Found provider as it relates to weight loss.
